Terms of Service

1. Who this is between

These terms are a contract between you (a natural person or a registered juristic entity) and SupamanPro (Pty) Ltd, registration number [[TO BE INSERTED: company registration number]], trading as Tender-Dude. When we say "we", "us", or "our", we mean SupamanPro (Pty) Ltd. When we say "you" or "your", we mean the person or entity who created or uses a Tender-Dude account.

By creating an account or using Tender-Dude, you agree to these terms. If you do not agree, please do not use the service.

2. What Tender-Dude is for

Tender-Dude finds the government and private-sector tenders that match your business profile, keeps your company documents organised and ready, and helps you build the bid pack. The decision to bid, what to submit, and the act of signing and submitting your proposal is always yours — Tender-Dude prepares and tracks; it does not decide or sign on your behalf.

3. Your account

Accounts are either opened by a workspace administrator provisioned by us, or created through self-serve sign-up. Either way:

  • One email address per account. You may not register the same email twice.
  • Your login credentials are for you alone. Do not share them.
  • You are responsible for all activity that happens under your account.
  • Tell us immediately at hello@tenderdude.co.za if you think your account has been compromised.

4. What you give us

You may upload company documents (tax clearances, B-BBEE certificates, registration documents, tender responses, and similar). You keep full ownership of everything you upload. By uploading, you grant us a limited licence to store the files, scan them for malware, extract text to power search and bid-fill features, and display them back to you. We do not use your documents to train any model, and we do not send them to an outside AI service.

You confirm that you have the right to upload anything you give us and that doing so does not breach anyone else's rights.

5. What we promise

We will take reasonable care to keep the service running and your data safe. Specifically:

  • We back up your data nightly to encrypted off-site storage.
  • We use TLS 1.2 or higher for data in transit.
  • We will notify you by email within 72 hours if we believe your personal data has been compromised, in line with POPIA requirements.
  • The app will go down sometimes for maintenance or because things break. We will try to keep unplanned downtime short. We do not promise a specific uptime percentage.

6. What we don't do

To be completely clear:

  • We do not decide which tenders you should bid on.
  • We do not sign bid submissions on your behalf.
  • We do not guarantee that following a Tender-Dude suggestion will result in a winning bid.
  • We do not provide legal or procurement advice. If you need that, please consult a qualified professional.

7. Payments

Payments are not switched on yet. Early users are not charged. This section describes how billing will work once it is enabled; the date billing starts will be posted on the pricing page.

When billing is enabled, Tender-Dude uses per-bid pricing — no subscriptions, no recurring charges. You pay only when you download a bid pack to hand in. Prices in South African Rand (ZAR) including VAT where applicable:

  • R130 for one bid download.
  • R350 for five bid downloads.
  • R600 for ten bid downloads.

You will see a clear total before you confirm any purchase. There is no auto-renewal because there is no subscription.

8. Our limits of liability

We are not liable for any indirect, incidental, or consequential loss arising from your use of Tender-Dude — including lost contracts, lost profits, or loss of data where that loss results from your own failure to maintain copies of your files.

Where the South African Consumer Protection Act (CPA) prohibits the exclusion of a particular liability, we do not exclude it. In all other cases, our total liability to you for any claim arising from or related to these terms or the service is capped at the total amounts you have paid to us in the 12 months immediately before the claim.

9. How this ends

You can delete your account at any time from your account settings. We will delete your data within 30 days of account closure, unless the law requires us to keep it for longer (for example, financial records under SA tax law).

We may suspend or close your account with reasonable notice if you breach these terms. In serious cases (fraud, abuse, or a legal requirement) we may act immediately and explain afterwards.

10. Changes to these terms

If we make a material change to these terms, we will send you an email at least 14 days before the change takes effect. Continuing to use Tender-Dude after that date means you accept the new terms. If you do not accept the change, you can delete your account before the effective date.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be resolved in the courts of Gauteng, South Africa.
